Following our last statement in August 2016, we advise that the matter initiated by the Fair Work Ombudsman(FWO), dating back to 2012, against the hospitality division of an OzStaff company and two managers for unauthorized deductions, and inaccurate records for ten employees, has reached a conclusion. Fines of $9,920 and $14,960 have been imposed by the Federal Circuit Court.

We can also report that Ozstaff has met all requests made by the FWO and, the court acknowledged that full rectification had taken place.
In addition to voluntarily reimbursing all affected employees by 2014, we have undertaken an in depth review of all our compliance and corporate governance practices, which the court also recognized.
Steps we have undertaken include;

* the development of rigorous policies, business systems, agreements and codes of practice, that meet or exceed all industry standards 

* the appointment of a qualified officer to oversee compliance and staff training 

* the engagement of external, independent auditors to provide annual reports on the company’s compliance obligations.

As we approach the penalty stage and conclusion of the case before the Federal Circuit Court in relation to the Fair Work Ombudsman vs OzStaff, we would like to provide you with an update about what happened and the steps we have taken to protect our clients, staff and people we work with.

What Happened?

This matter dates back to an audit by the Ombudsman initially in 2012, that ultimately led to a finding earlier this year, that the hospitality division of an earlier OzStaff company and two of its managers had been responsible for unauthorized deductions from employee wages, and for having provided inaccurate reports to the Ombudsman in February 2012.

Unauthorized deductions

Deductions were made at one of our client sites, from casual cleaners who were taking unauthorized, free meals from a client canteen. This was despite being told not to on several occasions, on pain of having their meal costs deducted from wages. This had also been outlined in notices to staff. Employees at the sites also had a weekly administration fee deducted from wages.
In all cases, both deductions were stated on employee payslips. Although some staff had once been given agreements dealing with deductions, this was not consistent.

Whatever view might be taken of the meals, the Ombudsman has stated that deductions must be in writing, and to an employee’s benefit, and that as a result the deductions were not authorized. OzStaff has accepted that position, and has willingly taken those requirements on board.

Inaccurate reports

The company responded to a series of requests from the Ombudsman from February 2012 to March 2013, for a wide number of records and payslips. With the exception of an initial set of documents given in 2012, all other documents provided were accurate. An updated set of documents was provided in May 2013 correcting the first set provided the year before.
Throughout this process the company met with and has been in regular contact with the Ombudsman to explain its position, the deductions and how staff were engaged.

How we responded

The Ombudsman has acknowledged that the company and its representatives had been cooperative. The company voluntarily reimbursed all affected employees by 2014. This included conducting lengthy searches to locate some employees who had left the business and settled interstate.

Corrective Action

OzStaff has undertaken a comprehensive review of our compliance and corporate governance practices. We are committed to being the industry benchmark for how we deal with and engage all our clients, employees, and those we work with.
Over the past four years we have developed rigorous policies, business systems, agreements and codes of practice, that meet or exceed all industry standards in the markets in which we work. Our risk management systems coupled with robust insurance coverage are now second to none.

Along with the appointment of a qualified officer to oversee compliance and staff training, we have appointed external, independent auditors to provide annual reports on the company’s compliance obligations, with a particular focus on finance, Safety, HR and employment practices.

Our objective is to provide the industry’s best level employment practices.

What’s next

This matter will conclude with a final hearing on the 26 th August 2016, after which the Court will make final orders. A further statement will be issued at the conclusion of the process.
